One million smokers appeal
Smoking has been linked with more serious Coronavirus cases and research suggests more than one million people in the UK – like David below – quit smoking since the start of the Coronavirus pandemic to protect their health. See https://www.bbc.co.uk/news/health-53403610
We are now launching a competition to find people in the North East who have quit due to Covid-19 and can help us inspire others to quit. Ts and Cs below:
- The promoter is: Fresh – Smoke Free North East, Salvus House, Aykley Heads, Durham, DH1 5TS.
- The competition will run from 2pm on Monday 3rd August 2020 (the “Opening date”) until 5pm on Friday 7th August 2020 (the “Closing date”) inclusive. All competition entries must be received by the Promoter above by the “Closing date”. All competition entries received after the “Closing date” are automatically disqualified.
- To enter the competition entrants must share their story about quitting within the comment section of the promoter’s competition Facebook post on their Facebook page www.facebook.com/freshsmokefree/. The aim of the competition is to find former smokers whose quitting stories inspires other smokers to quit – therefore a condition is that the winners must be happy to participate in publicity (e.g. Facebook and news media) including sharing their story and either supplying a good quality photo or having photographs taken and published.
- No purchase is necessary to enter the competition.
- Fresh or representatives will compile a “shortlist” of competition entrants and we will talk to those on the shortlist to find out more about their quitting story before deciding winners. This could include a face to face meeting, a telephone conversation and requesting independent verification that the winners were smokers
- The winners will be selected from a draw of valid entries on Friday 14th August 2020 (“Draw date”).
- By entering the competition entrants agree to be contacted by Fresh or representatives acting on behalf of Fresh.
- The winners will be notified in writing by Fresh or representatives on behalf of Fresh.
- If the winners do not respond by 5pm on Tuesday 18th August of being notified by the Promoter or rejects their prize, then the winner’s prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.
- The winners agree to the use of his/her name and image in any publicity material, as well as their entry. Any personal data relating to the winner or any other entrants will be used solely in accordance with current [UK] data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
- The winners will be contacted by either Fresh – Smoke Free North East or Gardiner Richardson, Fresh’s PR agency, on the promoter’s behalf.
- This competition is in no way sponsored, endorsed, administered by or associated with Facebook.
- The competition prize consists of:· Two winners will receive a £100 One4all gift card each.
- There is no cash alternative for the prize. The Promoter reserves the right to substitute the prize with a prize of similar value.
- The prize is not negotiable or transferable.
- The decision of the Promoter is final and no correspondence or discussion will be entered into.
- The Promoter does not accept any responsibility if you are not able to take up the prize.
- If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
- The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
- The prize will be awarded once the winner has entered into a discussion about their winning story. If this condition is not met, we reserve the right to withdraw the offer of the prize.
- Any costs incidental to the fulfilment of the prize other than the delivery of such by post are the responsibility of the winners.
- The prize will be sent to the winner by post within five (5 days) of the Promoter receiving the winner’s postal address. The winners are responsible for providing their correct postal address and the Promoter will not accept responsibility for any lost prizes and replacements cannot be sent.
The Promoter will not accept:
- Fresh accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
- Proof of posting or transmission as proof of receipt of entry to the competition.
- Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
- By entering the competition, you are agreeing to be bound by these terms and conditions.
The competition is open to all residents in the areas of Northumberland, Tyne and Wear and County Durham aged 18 years or over, except:
- Employees of the Promoter or its holding or subsidiary companies;
- Employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
- Members of the immediate families or households of (a) and (b) above.
In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize.
The Promoter may require you to provide proof that you are eligible to enter the competition.
The Promoter will not accept competition entries that are:
- Automatically generated by computer;
- Completed by third parties or in bulk;
- Illegible, have been altered, reconstructed, forged or tampered with;
- Photocopies and not originals; or incomplete.
- Entries on behalf of another person will not be accepted and joint submissions are not allowed.
The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.

Fresh – Smoke Free North East reserves the right to cancel this competition or to alter or amend it at any stage, if deemed necessary in its opinion, and if circumstances arise outside of its control.
The prize may not be transferred, sold, traded, or offered for sale; and may not be used as a prize or for any other promotional or trade purpose by any organisation other than Fresh – Smoke Free North East. The prize may be cancelled if offered for sale. No cash alternative is available and tickets do not hold any monetary value.
These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
